The following terms
of use apply only to the use of and purchases from Fabricated Glass Specialties, inc.
("FGS") website at www.fabglass.com. The terms "you", "your" and
"yours" refer to the user/customer utilizing our website to purchase merchandise ("Product") or to browse our website. The terms "we", "us" and
"our" refer to Fabricated Glass Specialties, inc. These terms may not apply to purchases made from our offices or in any other manner not utilizing fabglass.com
website.
Disclaimer of Warranty for www.fabglass.com Website
We provide our website and its contents on an "AS IS" basis and make no warranty
or representation regarding any Product, either express or implied, including
the warranties of merchantability, fitness for a particular purpose, and non-infringement,
which are hereby expressly disclaimed, unless otherwise stated.
Errors on Our Website
Despite our efforts to ensure that the information on our website is accurate,
complete and current, there may be instances when information about a Product
contains inaccurate or incomplete data, including data about the Product's price
or availability. We make no warranty or guarantee that the information on our
website is error-free, complete, or current. We reserve the right to correct
errors and/or update the content on our website at any time without notice.
We also reserve the right to refuse or cancel any order containing any error
or inaccuracy, including after the order has been submitted, whether or not
the order has been confirmed. If your order is canceled after your payment has been processed,
we will issue a full refund to your account.
Limitations and Exclusions
We reserve the right to change Product pricing, terms, specifications and warranties
without notice. In addition, we may revise these terms of use at any time by
updating the website. We reserve the right to limit the number of Products sold,
including the right to prohibit sales to individuals or end-users. Prices do not include shipping or tax.
If you are purchasing Products to be delivered to a country other than the United States of America, you are responsible for the necessary export documentation before shipment is made to a foreign country. We will not ship to foreign locations. We may however, at our choosing, deliver your product to a port of our choosing to facilitate your export process. Warranties for exported Products may vary or be null and void.
Damages
In no event shall Fabricated Glass Spcialties, inc. or their respective
officers, directors, employees, representatives or agents be liable for special,
incidental, consequential, punitive, indirect, or other special damages, including
but not limited to, loss of time, use, or profits, however caused, whether for
breach of contract, negligence, or otherwise, and whether or not we have been
advised of the possibility of any such damages.
Sales Tax Policy
We do business throughout the United States and accordingly collect sales and use tax as required
by applicable law. The tax rate applied to your order will generally
be the combined state and local rate for the address where your order was shipped,
delivered or picked up, provided we do not have an applicable resale certificate on file in our office at the time of order.
For any online purchase of a tax-exempt item, by completing the purchase, you certify that the item is being purchased for resale use only and you agree to assume liability for the applicable tax if the item is used for other than resale use.
Pick Up of Products At Our Locations
At the time of pickup, you or an authorized must inspect the product for any defects in material or workmanship.
Returns will not be allowed for products once they have left our location.
Shipped and Delivered Products
You may have your Product shipped or delivered to your location via one of our available
shipping or delivery options. We ship orders on normal business days, which are Monday through Friday
excluding specific holidays. Weekend shipment of orders is not currently available. All defects in material
or workmanship must be reported within 24 hours of receipt, due to the fragile nature of our product.
For those receiving product via a carrier other than FGS, noticable damage must be reported immediately
to the carrier.
Free delivery is available within the Fabricated Glass Specialties, inc. delivery area, via our own delivery vehicles, regardless of production facility, but may not be available in some areas. For those areas where delivery is available the method, vehicle, decision to package or not, will be left to FGS discretion
You assume all risk of loss for shipped Products other than "FGS delivery." Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products can not be shipped to incomplete addresses.
Order Cancellations
We are unable to refund any online purchase from the time your order is placed
(when you click the Submit Order button) until your Product is received by you
and returned to us. If you are not completely satisfied with your purchase after
receiving your Product, please contact our office to determine your preferred method of return.
Returns Policy For Purchases
We want to make sure you’re completely satisfied with anything you buy from
Fabricated Glass Specialties, inc. If you’re not completely satisfied with a
Product, Fabricated Glass Specialties, inc. will gladly exchange or repair
your product, at our choosing. Because of the fragile nature of our products,
all defects in material or workmanship must be reported within the specified
inspection period,
based on delivery method.
For determining the method of exchange or repair of a Product, we need the order number from our system. The Product must be in its original condition, including the box and/or packaging.
Credits will only be issued to the purchaser's account from the original purchase.
We reserve the right to limit the number of returns permitted.
Merchandise purchased online through fabglass.com (regardless of whether you picked it up or had it delivered to you), which meets the Refunds and Returns guidelines above, may be returned to our company. Before returning anything to us, you first must obtain a Return Authorization (“RA”) from our office.
Any returns delivered or given to an FGS delivery driver, without a pre-approved RA may be refused without notice, automatically returned and a handling fee assessed. An RA is valid for 45 days.
We will be responsible for all shipping and insurance charges for returns, unless otherwise indicated, as long as FGS has authorized the charges. Upon our acceptance of the product in like new condition in conformity with this policy, the purchase price will be credited to your account or we will repair the product, at our discretion Allow 30 days (not including delivery time) from when we accept your returned Product for the processing of your credit. For Product that we verify to be defective, we will reimburse you for your original shipping expense on the Product that you return.
Product Warranties
All Products are sold without warranty. We provide products on an "AS IS" basis
and make no warranty or representation regarding any Product, either express or implied, including
the warranties of merchantability or fitness for a particular purpose. All custom products made to
customers specifications are the sole responsibility of the customer. Fabricated Glass Specialties, inc. does
not provide recommendations or make suggestions as to the safety, or fitness for a particular purpose, for any
product which the customer designs and submits an order for.
Governing Law
These terms are governed and construed by the laws of the Oregon
without regard to its conflict of law rules. You agree that if any part of these
terms is found to be unenforceable, the remainder of these terms will remain
in full force and effect.
Fabricated Glass Specialties, inc. Announcements
Our press releases, announcements, and postings to site are done to allow customers
additional product knowledge. They do not constitute a recommedation on any product.
